CALL TO ORDER

1. Discussion regarding the Department of the Navy's response to Yuma County's counter-offer in the negotiation for the purchase and sale of County owned property within MCAS Yuma. [This matter is brought in Executive Session pursuant to A.R.S. § 38-431.03(A)(7).]

Chairman adjourns Executive Session and reconvenes Regular Session to begin.

Action to authorize an Executive Session of the Board of Supervisors pursuant to Arizona Revised Statute §38-431.03. (See separate Executive Session agenda.)

PLEDGE OF ALLEGIANCE

CALL TO THE PUBLIC: Call to the Public is held for public benefit to allow individuals to address issue(s) within the Board's jurisdiction. Board members may not discuss items that are not specifically identified on the agenda. Therefore, pursuant to Arizona Revised Statute §38-431.01(G), action taken as a result of public comment will be limited to directing staff to study the matter, responding to criticism, or scheduling the matter for further discussion and decision at a future date.

REGULAR SESSION AGENDA

PRESENTATIONS & ANNOUNCEMENTS: Note: Board members may discuss issues related to these presentations. No legal action will be taken.

1. Presentation of "The County Line" by Yuma 77, the Yuma Government Channel.

2. Presentation by Craig Williams, Yuma International Airport Director, on current airport activities and projects.

3. Board members may announce appointment(s) to the Board of Adjustment and/or Planning & Zoning Commission, as appropriate and necessary.

CONSENT CALENDAR: The following items listed under the Consent Agenda will be considered as a group and acted upon by one motion with no separate discussion, unless a Board Member so requests. In that event, the item will be removed for separate discussion and action.

1. Assessor: Approve Tax Roll Corrections as listed in batch dated March 2, 2009, pursuant to A.R.S. Title 42, Chapter 16, Article Vl. (A full list of the corrections is available from the Clerk of the Board).

2. Financial Services: Approve the Accounts Payable Demands disbursed in the amount of $7,945,018.82 and Payroll in the amount of $1,529,055.69 during the period of January 16, 2009 through February 04, 2009. ( The detailed list is available for review in the office of the Clerk of the Board.)

3. Clerk of the Board: Approve the minutes for the February 18, 2009 Executive Session and Regular Session.

4. Clerk of the Board: Approve the reappointment of Rick Dinsmore, Brenda Howell, Jeff Johnson, and Wayne Stuhr, and the appointment of Karen Johnson to the Yuma County Extension Advisory Board, terms to expire on June 1, 2010, as recommended by the Yuma County Cooperative Extension Director Kurt Nolte.

5. Clerk of the Board: Recommend State approval of a Special Event Liquor License Application submitted by John F. Friel dba St. John Neumann Roman Catholic Church for several fundraisers to be held at 11750 S. Mesa Drive, Yuma, AZ., on Sunday, March 15, 2009.

6. Clerk of the Board/Elections: Approve appointments to the Democratic Central Committee as recommended by the Party Chair, or as substituted by the Board of Supervisors: a) Precinct 15, Ervin K. Barnes; b) Precinct 21, Michael H. Baughman; and c) Precinct 36, Gabriel Ortiz, Jr.

7. Clerk of the Board/Elections: Adopt Budget Amendment Resolution No. 09-102 authorizing the transfer of funds up to $70,000.00 from General Fund Contingency to the Elections department supplies and services budget for Fiscal Year 2008-09.

8. Development Services: Action to accept the 2008 Yuma County Flood Control District Assessment Report.

9. Development Services: Authorize the County Engineer to acquire by donation, purchase or condemnation, the Right-of-Way necessary for the intersection improvement of Payson Drive at the South Frontage Road.

10. Public Health Services District: a) Adopt Budget Amendment Resolution No. 09-103, authorizing an increase in budget authority of $63,215.00 for the Women, Infants, & Children (WIC) Services Program; b) Adopt Budget Amendment Resolution No. 09-104, adding one (1) Community Nutrition Worker (CNW) to the WIC Services Program (Contract No. HG861144); and c) Authorize the Health Director to sign Amendment No. 3 to Intergovernmental Agreement No. HG861144 for the WIC Services program between Yuma County and the Arizona Department of Health Services.

11. Free Library District: a) Acknowledge the receipt of a bequest of Mutual Funds from the estate of Elizabeth C. Magee to the Yuma County Free Library District, and b) Authorize the Chairman of the Board of Supervisors to sign the certification of the Non-Corporate Resolution naming the officers to manage the investment account.

12. Justice Court: Approve an addendum to an Intergovermental Agreement between Yuma County Justice Court and San Luis Municipal Court for weekend and holiday court coverage.

13. Justice Court: Approve an addendum to an Intergovermental Agreement between Yuma County Justice Court and Somerton Municipal Court for weekend and holiday court coverage.

14. Justice Court: Approve an addendum to an Intergovernmental Agreement between Yuma County Justice Court and Yuma Municipal Court for weekend and holiday court coverage.

15. Justice Court: Approve an addendum to an Intergovernmental Agreement between Yuma County Justice Court and Wellton Municipal Court for weekend and holiday court coverage.

DISCUSSION AND ACTION ITEMS: The Board will open each of the following items separately for discussion and action, as appropriate.

1. Public and Legislative Affairs: Discussion and possible action regarding Yuma County's Legislative Agenda for the 2009 Legislative Session.

2. EVENTS CALENDAR: Board members and County Administrator will report and may discuss events attended or to be attended on behalf of the County, and may update the schedule for future Board of Supervisor's meetings, as appropriate. No legal action will be taken.

PLANNING & ZONING AGENDA: Full legal descriptions of property sites for all Rezoning Cases are available for public review at the Yuma County Board of Supervisors' Office.

EXPEDITED REZONING and PUBLIC HEARINGS: These items will be opened as a group for public hearings and acted upon by one motion to adopt the recommendation of the Planning & Zoning Commission, except for any item that is removed by a Board member for separate consideration. That item will be discussed and acted upon separately following action on expedited items.

1. Development Services: Minor Amendment Case No. 2008-MA-11: Wayne Eide, agent for Mobile Land, LLC requests a Minor Amendment to the Foothills Sub-regional Planning Area of the Yuma County 2010 Comprehensive Plan to change the land use designation of a 4.12 (gross) acre parcel from Low Density Residential (R-LD) to Commercial/Trade
(C-CT), Assessor's Parcel No. 729-04-090, located at the northwest corner of Avenue 15E and 41st Lane, Yuma, Arizona. The Planning Commission (9 to 0 vote) and staff recommend approval.

2. Development Services: Rezoning Case No. 08-27: Request by Wayne Eide, agent for Mobile Land, LLC, to rezone a 4.12 (gross) acre parcel from Rural Area-10 acre minimum (RA-10) to General Commercial (C-2), Assessor’s Parcel No. 729-04-090, located at the northwest corner of Avenue 15E and 41st Lane, Yuma, Arizona. The Planning Commission (9 to 0 vote) and staff recommend approval, subject to the Performance Conditions and Schedule for Development.

3. Development Services: Rezoning Case No. 08-25: Request by Yuma Territorial Engineering, agent for Garcia Express LLC., to rezone a 13.5 (gross) acre parcel from Rural Area-10 acre minimum (RA-10), to Light Industrial- 2 acre minimum (LI-2), Assessor’s Parcel No. 104-21-013, located at the southeast corner of the intersection of Avenue A and the alignment of County 15 ½ Street, Yuma, Arizona, and within the 70-75 dB noise zone. The Planning Commission (9 to 0 vote) and staff recommend approval, subject to the Performance Conditions and Schedule for Development.

REZONING -- REGULAR PUBLIC HEARING ITEMS: Staff will make a full presentation on each of the following items, followed by separate discussion, public hearing, and action by the Board of Supervisors.

1. Development Services: Rezoning Case No. 08-26: Request by Yuma Territorial Engineering, agent for Randy L. Brown, to rezone a 10.0 (gross) acre parcel from Rural Area-10 (RA-10) acre minimum to 5.0 acres (north half) of Rural Area-5 acre minimum (RA-5) and 5.0 acres (south half) of Suburban Site-Built -2 acre minimum (SSB-2), Assessor’s Parcel No. 101-19-042, located at 2781 West County 17th Street, Somerton, Arizona. The Planning Commission with a (9 to 0 vote) and staff recommend approval, subject to the Performance Conditions and Schedule for Development.

2. Development Services: Special Use Permit Case No. 08-18: Request by Rick D. and Barbara M. Black for a Special Use Permit per Section 1106.01(C) of the Yuma County Zoning Ordinance to allow a cargo container as a permanent accessory building on a 12,033 square foot parcel zoned Low Density Residential-12,000 square foot minimum (R-1-12), Assessor’s Parcel No. 112-58-029, located at 14772 South Verde Avenue, Yuma, Arizona. The Planning Commission (9 to 0 vote) and staff recommend denial.

Action to adjourn until March 16, 2009.

Note: The Board may vote to hold an Executive Session for the purpose of obtaining legal advice from the Board's attorney on any matter listed on the agenda, pursuant to Arizona Revised Statute §38-431.03(A)(3).
